Concerning the legalization and regularization of unauthorized constructions: property owners have the opportunity to regularize any planning violations on their properties. On 3/11/2017, Law 4495/17 on the "control and protection of the built environment" was published; its Section D re-establishes the rules for the regularization of unauthorized constructions predating 27-7-2011.

The regularization of unauthorized constructions and the engineer's certificate are now mandatory for every transfer or establishment of a right in rem over a property (including those without a building) on which an unauthorized construction has been carried out or an unauthorized change of use has been established.

Regularization procedure

The procedure for regularizing unauthorized constructions essentially consists of two steps.

Step A

The interested party approaches an engineer and assigns them the legalization procedure. At this stage the engineer informs the client about the necessary documents. The engineer then carries out an on-site inspection of the space under review: the space is surveyed, compared against the drawings of the existing permit to record the violations, and photographed. After the inspection, a provisional fine is calculated. The engineer submits the electronic declaration, and the system issues a unique number for the unauthorized construction, along with a payment order for the inclusion fee. At the same time, the method of paying off the fine is determined. The fee is paid by the client at any bank or via web banking. Certification of the fee payment marks the start of the inclusion procedure.

Step B

One month after the start of the inclusion procedure (i.e. the submission of the declaration), the client can begin paying off the fine. They can also monitor the payments and the remaining balance via a code provided by the engineer. During the same period, the engineer prepares and gathers all the required documents, drawings and studies on their side, and calculates the final fine, based on which the remaining installments are recalculated in the system.

Finally, after the fine has been paid off, the engineer submits all the required documents to the system. Once their completeness is certified, the "Regularization Certificate" is issued automatically. This is a standardized document containing all the details of the unauthorized construction and its owners.

The certificate is delivered to the client together with the regularization drawings.
