About Legalization and Settlement of Arbitrary Buildings, property owners have the option of resolving any planning violations on their property. On 3/11/2017 Law 4495/17 was published on “control and protection of the built environment” and which in Section D again imposes the rules for the regulation of arbitrators before 27-7-2011.
Arbitrariness regulation procedure
The settlement of arbitrariness and the engineering certificate are now mandatory for any transfer or establishment of a right in rem to property. (including those without a building), which has performed an arbitrary construction or installed an unpredictable change of use. Therefore, the process of regulating arbitrary structures consists mainly of two steps.
Phase A
A) First of all, the person concerned should address the issue to an engineer and entrusts him with the procedure for the Arbitrary Buildings. At this stage, the engineer informs the customer of the necessary documents that will need and for the continuation of the process (such as license and drawings of the existing building, owner details, etc.).
The engineer then performs an autopsy on the site and compare it with the designs of the existing permit (where applicable). Recording the arbitrariness and taking photos of the site.
After the autopsy, he calculates a provisional fine, submits the electronic declaration, and a “unique number” for the arbitrary and payment order for the affiliation fee (fee). Furthermore, it determines how they will repay the fine.
The customer pays the fee at any bank institution or through web-banking. The certification of the payment of the fee marks the beginning of the entry process.
Phase B
B) One month after the entry procedure (i.e., the submission of the declaration), the customer may begin repaying the fine. ‘He can control payments as well, as the balance of the fine through a code supplied by the engineer.
At the same time, the engineer draws up and collects all the prerequisites on his part. (documents, plans, studies). Calculates the final fine, that the system redefines, and the balance of the instalments for his repayment.
Finally, after the repayment of the fine, the engineer submits all the required documents to the system. If their completeness is certified, the “Certificate of Arbitrary regulation” is automatically in the issue. The system standardises the document containing all elements of arbitrariness and owners.
The document of the certificate is delivered to the customer together with the plans of the settlement.
